By accessing our website, purchasing services, or engaging in a contract with us, you agree to these Terms & Conditions.
Please read them carefully before using our services.
1. Definitions
Client / You – The individual or business purchasing our services.
Services – All digital services offered by Digital Estate including:
Social Media Marketing, SEO, Website Development, App Development, Custom Software, Graphic Design, GHL-CRM, Web Apps, Hosting, and Consultation.Agreement – The contract formed between the Client and Digital Estate.
Deliverables – Final work provided to the client based on the service package.
2. Scope of Services
Digital Estate provides the following services:
Website Development
App Development
Social Media Marketing
Search Engine Optimization
Graphic Design
Custom Software Solutions
CRM Setup & Automation (including GHL)
Digital Advertising & Media Buying
Web Apps & SaaS Development
Consultancy & Training
Each service includes specific deliverables that will be outlined in the project proposal or invoice.
3. Client Responsibilities
The Client agrees to:
Provide accurate information required for service delivery.
Provide timely feedback, approvals, and access (hosting, CRM, social media, etc.).
Ensure that all materials provided (images, text, videos) do not violate copyright laws.
Maintain valid licenses for any third-party tools required for the project.
Make payments on time according to the agreed terms.
4. Payment Terms
Payments are non-refundable once work has commenced.
Advance deposits may be required before starting a project.
Monthly services (SMM, SEO, GHL) require payment before the new month begins.
Late payments may result in:
• project delays
• suspension of service
• additional late feesFor software/app development, milestone-based payments may be used.
5. Service Timelines
All timelines are estimates and depend on Client responsiveness.
Delays caused by the Client (late approvals, access issues) may extend the delivery date.
Digital Estate is not responsible for delays caused by third-party platforms (Facebook, Google, Hosting, APIs, etc.).
6. Revisions
Each service comes with a limited number of revisions as stated in the package.
Additional revisions will be charged separately.
Major feature changes or redesign requests count as new work and require a new quote.
7. Third-Party Tools & Integrations
Some services require third-party integrations such as:
Hosting providers
Domain registrars
CRM systems (GHL, HubSpot, etc.)
Google Analytics / Tag Manager
Facebook Pixel
Email marketing tools
API providers
Digital Estate is not responsible for:
Third-party downtime
Account bans/suspensions
API restrictions
Changes in platform policies
The Client must maintain active subscriptions for such services.
8. Intellectual Property Rights
8.1 Client Materials
All content provided by the Client remains their property.
8.2 Digital Estate Deliverables
Ownership of final deliverables will be transferred to the Client only after full payment has been made.
This includes:
Website source files
Software code
Designs
Marketing creatives
App builds
Funnels and automation workflows
Digital Estate retains the right to use the final work in portfolio or marketing unless the Client requests confidentiality in writing.
9. Confidentiality
Both parties agree to keep all sensitive information confidential, including:
Business strategies
Login credentials
CRM data
Contact lists
Project documents
Data will not be shared with third parties except subcontractors involved in the project under NDA-level confidentiality.
10. Service Limitations & Disclaimers
Digital Estate does not guarantee:
Specific ranking on Google
Specific number of leads or sales
Social media growth
Platform approvals (Google Ads, Facebook Ads, App Stores)
No downtime (in case of hosting or third-party API issues)
Digital Estate works on best-effort basis using industry-standard practices.
11. Liability
To the fullest extent permitted by law:
Digital Estate is not liable for indirect, incidental, or consequential damages.
Maximum liability is limited to the amount paid for the specific service.
The Client is responsible for backing up their own data unless backup services are included.
12. Termination
Either party may terminate the agreement if:
There is a breach of contract
The client fails to pay on time
The project is inactive due to no response for 14+ days
Mutual consent is given
Upon termination:
No refunds are provided for completed work
All pending invoices must be paid
Digital Estate may stop further work immediately
13. Refund Policy
Digital Estate follows a strict no-refund policy for:
Work already started or completed
Digital services delivered
Monthly retainer services (SEO, SMM, CRM)
Custom software, apps, or website development
Refunds may be considered only if work has not started at all.
14. Content Ownership & Usage
The Client ensures that all content provided:
Does not contain copyrighted materials
Does not include illegal or harmful content
Is safe for publishing online
Digital Estate reserves the right to refuse working on unethical or illegal content.
15. Support & Maintenance
Support or maintenance for services such as:
Websites
Mobile apps
Web apps
CRM automations
Is not included unless the Client purchases a support package.
16. Governing Law
These Terms are governed by the laws of:
United States (for US clients)
Pakistan (for local clients)
Any disputes shall be resolved through arbitration or courts in the relevant jurisdiction.
17. Changes to Terms
Digital Estate may update these Terms periodically.
Updated versions will be posted on the website with a new “Last Updated” date.
